Terms and conditions of use

By purchasing a ProDieselChip unit from us or otherwise using this Website you agree to be bound by these Terms and Conditions.

Ordering & Shipping

1) The majority of orders are dispatched within 1-3 working days for next working day delivery, but please allow up to ten working days for delivery (especially for international orders).

2) All goods remain the property of ProDieselChip until full payment is received.

Warranty

3) All ProDieselChip units carry a non transferable 3 Year product warranty from date of purchase.

3.1) The warranty that we offer does not extend to damage or failures which arise from improper use, wear and tear, wilful damage, accidents, failure to follow instructions, or any repair or modification made without our consent.

3.2) Our warranty is only valid in respect of a ProDieselChip unit which has been fitted and installed in accordance with instructions.

3.3) If units are found to be faulty within the warranty period, the unit must be returned to ProDieselChip in the UK for repair in the first instance following the returns procedure detailed in point 5.

3.4) This warranty represents your sole remedy against us that we may provide to you for defective ProDieselChip units.

Returns

4.1) If you wish to return your unit then please get in touch so we can guide you through the returns process

4.2) If within the first 14 calendar days from point of receipt of goods you decide not to keep the unit, then we will refund your purchase price including outgoing postage costs, you will be responsible for the cost of returning the goods.

4.3) Your original purchase amount will be refunded via your original payment method upon receipt of returned goods at our office in the UK.  Return postage fees will not be refunded.

4.4) When returning goods only use parcel carriers who are able to track products when in transit.  The product must be properly packed and returned in re-saleable condition, including a copy of the original invoice.

4.5) Please specify clearly in all correspondence that you want to make use of the right of cancellation and that consequently you want to have the amount refunded.

4.6) Goods returned without notification will take longer to process so it's important to communicate clearly your intention to return in advance.

Limitation of Liability

5.1) We disclaim any and all liability to you for the supply of the ProDieselChip unit to the fullest extent permissible under applicable law. This does not affect your statutory rights as a Consumer. If we are found liable for any loss or damage to you such liability is limited to the amount you have paid for the relevant ProDieselChip unit. We cannot accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits, to you howsoever arising.

5.2) We shall not be held liable for any failure or delay in delivering ProDieselChip unit where such failure arises as a result of any act or omission which is outside our reasonable control such as an act of God or those of third parties which shall include, but is not limited to, any labour strikes, bad weather conditions, fires, governmental actions, war or terrorist acts.

5.3) We do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss or damage to property and/or loss from claims of third parties arising out of the use of the ProDieselChip unit purchased from us.

5.4) it is your responsibility to ensure you notify you insurance provider about any modifications to your vehicle, including but not limited to the use of the ProDieselChip unit on your car

5.5) Whilst the ProDieselChip unit has been designed in such a way as to minimise the likelihood of its use infringing a motor manufacturer’s warranty we cannot warrant or guarantee that its use on a particular vehicle will not infringe all motor manufacturer’s warranties (which may change from time to time). We do not accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits, suffered or incurred by you as a result of your failure to notify your insurer of the use of the ProDieselChip unit or infringing a motor manufacturer’s warranty or the wear rate of perishable items such as clutches and tyres and/or any mechanical or subsequent failure from use of the ProDieselChip unit.

5.6) We shall not be held liable for any misrepresentations.

5.7) We accept no liability whatsoever for damaged caused during fitting a ProDieselChip unit.

5.8) Power/MPG figures in all ProDieselChip publications cannot be guaranteed, however should be achievable in most cases

Online dispute resolution for consumers

The consumer resident in Europe must be aware that the European Commission has established an online platform for alternative dispute resolutions that provides for an out-of-court method to solve any dispute related to and stemming from online sale and service contracts. As a consequence, if you are a European consumer, you can use such platform for resolving any dispute stemming from the online contract entered into with the Owner.
